It’s one of the charges against ZimmermanIt’s not yet clear if there are any charges.  Murder-2 is the only charge.

First off, good luck finding twelve unbiased qualified adults in Florida to be on a jury.

Second, if Murder-2 is the only charge because Murder-2 is the only charge, then that makes me think Corey knows there is no case, and she doesn’t really want to prosecute but for external pressure forcing her hand.  If she wanted a conviction, she’d file charges on every possible crime that fits his alleged actions, save Murder-1 which she punted on because she didn’t use a GJ, and Florida law requires Murder-1 to start with a GJ.  That way, if you charge him with everything from Murder-2 to lesser degrees of murder (if Florida law permits), to manslaughter to ACA to UUW, that increases the chances that the jury (if one can be found) will convict him of something.  I think in these circumstances, you can read a lot into her charging him with only the most serious crime she could with her own hand.

Third, you can forget about Peru.  Zimmerman’s been in hiding, but he has kept the cops up on his QTH.  (UPDATE:  He apparently never fled Florida even while he was in hiding.)

Fourth, an October acquittal and riots to get Obama out of office is out of the question.  A Murder-2 case will probably take about a year, and this particular case will take longer because jury selection is going to be a lot longer and more hairy.

(2) The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.
(3) When a person is killed in the perpetration of, or in the attempt to perpetrate, any:
(a) Trafficking offense prohibited by s. 893.135(1),
(b) Arson,
(c) Sexual battery,
(d) Robbery,
(e) Burglary,
(f) Kidnapping,
(g) Escape,
(h) Aggravated child abuse,
(i) Aggravated abuse of an elderly person or disabled adult,
(j) Aircraft piracy,
(k) Unlawful throwing, placing, or discharging of a destructive device or bomb,
(l) Carjacking,
(m) Home-invasion robbery,
(n) Aggravated stalking,
(o) Murder of another human being,
(p) Resisting an officer with violence to his or her person, or
(q) Felony that is an act of terrorism or is in furtherance of an act of terrorism,
by a person other than the person engaged in the perpetration of or in the attempt to perpetrate such felony, the person perpetrating or attempting to perpetrate such felony is guilty of murder in the second degree, which constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.

This is why I say Corey is bloviating. She over-charged GZ for a reason. It would be like a corrupt DA who wants to split the proceeds of a bank robbery, so when the cops bring him in, he files rape charges. Duh, the jury will acquit.

Armed Criminal Action. I shouldn’t have said it here, because Missouri is the only state I know of that calls this particular offense ACA. Basically it’s a felony crime of committing a felony with a deadly weapon. In other words, it’s an add-on felony for purposes of negotiation and plea bargaining.

ACA in Missouri also means Assistant Circuit Attorney, an acronym I use a lot, the equivalent of an Assistant District Attorney. That means that ACAs deal with ACAs all the time :)

I know exactly what Angela Corey is doing. And for that reason alone there should be a rope ready for her alone on one side of the scale of justice, just for balance.
